| 摘 要： | 劳动权是一项重要的宪法权利,对劳动权的保障是关系到社会和谐的大事。劳动权入宪经历了一个发展过程,体现了劳动权具有的自由权和社会权的双重属性。宪法劳动权的完善,必须以劳动权的这两层属性为基点,参照《经济、社会、文化权利国际公约》的规定完善其内容,激活劳动者的宪法权利,这对于处在社会转型期的中国具有特别重大的意义。
