| 摘 要： | 商业秘密法可以被看成是在商业秘密权人的垄断利益与社会公共利益之间的一种利益分配、法律选择和整合.商业秘密法保护的利益主要有商业秘密权人的利益、社会公众的利益、商业秘密权人的竞争厂商的利益等.商业秘密法的平衡机制主要体现于对信息流动限制与公众自由获得信息的利益平衡、商业秘密权与雇员劳动就业权的利益平衡等方面.

| Abstract: | Trade secrets law can be regarded as the interests distribution and ju ristic selections and integration between public interests of the society and th e monopoly interests of trade secrets owners. The interests protected by trade s ecrets law mainly include the interests of the owner of trade secrets, the inte rests of public and the interests of the competitive manufacturers authorized by the owner of trade secrets. The balancing mechanism of trade secrets law mainly embodies the balancing of interests between the restraint on information fluxio n and the public free access to information, between the right of trade secrets and the right of the employee's to work and take up occupations. |
