| 摘 要： | 一般认为,宪政是一种以限权、防权为设防的现实主义学说。宪政不仅是现实主义的,而且又是理想主义的。宪政的现实主义以它的理想主义为前提,是带着道德感和责任感的现实主义;宪政的理想主义隐含于它的强烈的现实感之中,它不是高调、积极的理想主义,而是低调、"消极"的理想主义。宪政的消极理想主义体现了宪政对人性、权力与政府的人文关怀与人文期待。

| Abstract: | Generally speaking,constitutional government is a realistic doctrine of limiting power and protecting power.It is not only realistic but idealistic.The realism of constitutional government is based on its idealism and with the realism of the sense of moral and the sense of responsibility.The idealism of constitutional government hides its content in the strong sense of realism.It is not high tune and active idealism but low tune and passive idealism.The passive idealism of constitutional government reveals the human concern for and expectation of humanity,power and government. |
