金融调控法与金融监管法的比较分析

按法理学有关法律部门调整对象单一性的理论,金融法并不是一个独立的法律部门,而由金融调控法、金融监管法以及金融交易法等三部分建构。但长期以来的经济法学研究忽略了这一点,尤其是表现在宏观调控法研究上,轻易把性质迥异的金融监管法或金融交易法划入调控法范畴。鉴于此,我们必须对金融监管法与金融调控法的差异作一定区分,以求对金融法与宏观调控法的理论研究之发展和完善有所裨益。

A Comparison between Financial Regulation Law and Financial Supervision Law

Both the financial regulation law and the financial supervision law are parts of financial law system. They are important for the study of economic laws but are usually ignored in the general study. Based on the entirely different engendering background and functional properties, they have differences in many aspects, In this paper, we have studied and clarified the obscure demarcation of financial regulation law and financial supervision law which could benefit the de-velopment of financial law and micro-control laW. .
