基于社会学观点对法律运行过程的展开

在现有理论中，法律运行过程研究大致可以分为整体主义和极端个人主义两种研究进路。实质上，它们都没有完整描述现实社会中真实的法律运行过程，因为从社会学中人的社会化理论看，法律运行过程是法律社会化和人的社会化的结合：从横向分析，法律运行过程是一个法律因素和社会因素通过法律社会化与人的社会化而被人所认同、接受法律影响进而影响法律运行的过程；而从动态看，它也是一个法律社会化与人的社会化在其内容、程度、动力机制等方面博弈的过程。因此，法律运行全过程必须强调对社会成员最根本的生理需要以及在此基础上衍生出的其他社会需要的满足。

The Transverse and Dynamic Expansion of the Process of Law Operation: A Sociological Perspective

The studies into the process of law operation are either whole-oriented or individualoriented in current theories. In fact, the two ways fail to thoroughly describe the actual process of law operation. Viewed from the human＇s socialization theory in sociology, process of law operation is the integration of law＇s socialization and human＇s socialization. Transversely, the law operation is a process influenced by both legal factors and social factors and a process in which humans accept the behaviors influencing the main body of law operation by way of law＇s socialization and human＇s socialization. Dynamically, the law operation is a process of game between law＇s socialization and human＇s socialization in such aspects as content, degree and dynamic mechanism. Therefore, the whole process of law operation must focus on meeting the essential biological demands of social members as well as other social demands.
