恢复性司法中的被害人

恢复性司法是通过恢复性程序实现恢复性结果的一种被害人司法。被害人参与恢复性司法具有全面性、实质性和有效性。恢复性司法中的被害恢复包括物质与精神损害恢复,以及人际关系恢复两个方面。从最大限度地保障被害人人权这个宗旨来考虑,恢复性司法原则上不应当为被害人设定责任。

Restorative justice is a victim justice through the process of restoration to achieve restorative results.It is comprehensive,substantive and effective for Victims to participate in restorative justice.Victims restoration in restorative justice include the restoration of the material,moral damage restoration,and the restoration of interpersonal relationships.From the purpose of the protection of victims human rights to the largest extent,in principle,we should not set up responsibility for the victim in restorative justice.
