| 摘 要： | 侵犯知识产权是一种违法应受制裁的行为，也是一种不道德应受谴责的行为，还是一种侵权者在“窃”不是“偷”、“君子无私，小人有义”、“大公无私，拿来无过”等病态心理状态下实施的一种病态行为。导致其病态心理的原因有1．侵权客体的特殊性淡化了侵权者的羞耻感、负罪感；2．虚伪的“荣誉感”和扭曲的“幸福感”，成为侵权者道德天平上的砝码；3．侵权者的道德情感错位。根治侵权犯罪行为，除对侵权者进行法律制裁外，还必须辅以道德的矫治。道德矫治的具体方式有1．通过道德反省、道德培养等方式，由自审的道德法庭－“良心”来矫治；2．通过道德范例、道德传播等方式，由公省的道德法庭－“舆论”来矫治。
