再论司法判例制度的性质、作用和过程

判例制度的首要原则是强调说理和辩论,因而审判委员会在统一判决的过程中必须充分尊重并公开表达不同意见。同时,判例制度离不开判决的公开、评判和梳理机制。判例公开不仅有利于本法院和其他法院(尤其是下级法院)判决的统一,而且有助于社会和学术界监督司法判决的公正性与合理性,并提高司法判决的可预测性。在这个意义上,判例制度是目前强调审判质量及其公开与公正的司法改革的自然延伸。如果得以适当建立,判例制度将极大地促进中国的法治进程。

On the Nature,Role and Process of the Case Law Method

This thesis deals with the nature,role and process,and the Universal principle of the case law methed through the analysis of the typical cases against American constitution,The chief principle of the case law method is the emphasis of reasoning things our and argument, therefore,the judicial committee must respect fully and express different opinions publicly in the process of unified judgment,Meanwhile, the case law method does not work without open judgment, judging and carding mechanism. The case law being brought into the open is not only favourable for the unification of judgment by this and other courts (especially the lower level ones)but also helpful for the supervision by society and academic world to see whether the judgment is fair and reasonable.Besides,the predictability of judicial judgment can be raised. In this sense, the case law method is the natural extention of judicial reform which at present emphasizes judicial guality, impartiality and openness. If properly established, the case law method will greatly improve Chinese judicial course.
