| 摘 要： | 我国计划生育国策实施以来取得了辉煌的成就,随着人权保护意识的提高,2000年我国法律将计划外生育费改为社会抚养费。但是理论界对社会抚养费没有进行充分的论述,而导致社会抚养费的征收出现了一定的困难。我们只有将人类和环境视为一个整体,从环境权的本质、代际公平、代内公平和生育权的内在联系才可以给出社会抚养费征收的理由,同时也只有按照这个认识采取相应的措施才可以保证社会抚养费的顺利征收。

| Abstract: | The family planning is one of our national policies and it is prescribed in the Constitution that couples have the obligation to carry it out.In 2000,the extra-birth fee was changed into the social allowance.However,the present theories do not make a very clear explanation about the property of the social allowance,which is embodied in the misunderstanding of the concept in practice.In light of the environmental rights,the paper discusses the property of the social allowance and its necessity with the purpose of make a fire-new explanation of the family planning in our country. |
