| 摘 要： | 2009年WTO专家组裁定我国《著作权法》第四条第一款不符合不符合《伯尔尼公约》和TRIPS协定，这使得我国必须进行相关的法律修改。从该条的社会效果来看，《著作权法》第四条第一款在国际贸易中起到了贸易保护的作用。我国要正确评估WTO专家组的两个报告对我国国际贸易的影响，在最大限度维护我国利益的前提下运用WTO规则对该条进行修改。

| Abstract: | World Trade Organization expert panel judged that the article four in paragraph one in China's copyright law did not conform to the Berne convention and TRIPS agreement in Sino-US dispute on intellectual property right so that China has to amend the fourth article in paragraph one in China's copyright law.
