外资法调整对象新探

我国外资法律体系的调整和重构问题是国内学界近几年争论较多的话题。但国内学者在论述外资法律体系的调整和重构时,往往就外资法律体系重构的基础——外资法的调整对象,却未能有清楚、统一的认识。该文在对我国目前外资法律体系下的外资法调整对象进行分析的基础上,通过外资法调整对象与民商法调整对象及一般国内经济法调整对象的学理辨析,进而明确我国外资法调整对象的应有内涵与外延,以期为外资法律体系的重构工程打好根基。

A New Perspective of Regulatory Object of Foreign Investment Law

There has been no clear and unified definition of the regulatory object of the foreign investment law,while the reconstruction of the foreign investment law system has been the popular topic in China.This paper first gives a general definition of regulatory object in the present system,and then in contrast to the regulatory object of the civil law and other domestic economic law departments,this paper gives a new definition of the connotation of the regulatory object of the foreign investment law.Further,after a review of the other countries' regulatory object,this paper demonstrates the specific range of constitution of the regulatory object.
