| 摘 要： | 在建构与国际投资贸易通行规则相衔接的中国自由贸易试验区纠纷解决机制过程中,结合美国在涉对外贸易区立法、涉自由贸易案件管辖权以及完善替代性纠纷解决机制等方面的成熟经验,从国内法与国际法逐步实现制度衔接以及国内自贸区纠纷解决机制中的协调与竞争两个层面加以探讨,以期为我国自贸区纠纷解决机制的建构和制度创新提供借鉴。

| Abstract: | The dispute settlement mechanism should be connected with the general rules of international investment and trade in the process of construction in pilot free trade zones in China. And the mechanism should be combined with the mature experiences of legislation of foreign trade zones, jurisdiction of free trade cases and perfection of Alternative Dispute Resolution(ADR)mechanism in U.S.A. It is discussed from two dimensions, namely, the gradual realization of institutional convergence between domestic law and international law, and the coordination and competition of dispute settlement mechanism of domestic free trade zones. References are suggested for the construction and institutional innovation of dispute settlement mechanism of free trade zones in China. |
