地方大气污染防治立法技术分析

由于各地区地理环境、经济发展水平等方面的差异,在大气污染立法领域仅有上位法规定是难以适应不同地区实际情况的。随着我国地方立法的开放,大气污染地方立法成为完善大气污染防治立法体系的必然选择。大气污染防治地方立法是国家立法的细化、解释与补充,以《河北省大气污染防治条例》为样本,对我国省级大气污染地方立法的法律条款设置进行具体的剖析。提出地方大气污染防治立法的三种科学化选择,即应在上位法的基础上进行必要而不机械的重复与回应、合理而有效的集成与细化以及自主且合法的先行与创设。

Technical analysis of local legislation of prevention and control of air pollution

Due to the differences of geographical environment and economic development level etc., in various regions, it is difficult for the provisions of lex superior only to adapt to the actual situation in various areas in the field of air pollution legislation. Along with the opening of local legislation in China, the local legislation of air pollution has become an inevitable choice of perfecting the legislative system of prevention and control of air pollution. The local legislation of prevention and control of air pollution is the refinement, interpretation and supplement of national legislation of prevention and control of air pollution. The Regulations on Prevention and Control of Air Pollution in Hebei Province is taken as a sample, and the setting of legal provisions of provincial legislation of prevention and control of air pollution is analyzed in detail. Three scientific choices of local legislation of prevention and control of air pollution are brought forward, namely, to conduct necessary and non-mechanical repetition and response, to conduct reasonable and effective integration and refinement, and to conduct independent and legitimate initiative and creation based on lex superior.
