| 摘 要： | 反垄断法作为“经济宪法”，对维护市场自由和公平竞争起到了至关重要的作用。我国新颁布的《反垄断法》的规定尚存在立法缺陷，如：没有说明反垄断法的宪政意义、规定的各种法律责任较轻、对行政性垄断执法的规定比较含糊等。本文试对这些缺陷进行探讨并提出一些完善的立法建议。
