论《物权法》中土地征收制度的创新与不足

在我国现代化进程中,随着工业化和城市化的加速进行,城市不断向郊区农村索取集体土地。在这个过程中,农村发展和农民的收入增长滞后,征地中农民利益受到损害等问题成为社会关注的焦点。《中华人民共和国物权法》是确认财产、利用财产、保护财产以及调整财产关系的基本法律,是当今处理征收集体土地各种矛盾和利益关系的依据。土地征收制度的创新对于保护权利人的物权,定纷止争,促进和谐社会建设,具有十分重要的意义。

Discussion on inadequacies and Innovative Aspects of Land Acquisition System in the "Property Law"

Urban area is becoming more and more large in the process of China's modernization.Rural de- velopment and farmers income growth lagged behind in this process,its became the focus that harming the in- terests of the community of peasants and other issuesin the land acquisition."Real Rights Law of Peolple's Re- public of China"is a basic law to identify property,use property,protect property and adjust to property rela- tions.Nowadays it is also a basis of dealing with collective land's contradictions and interests.The innovation of land acquisition system is of great significance for the protection of property rights,prevention issues and pro- motion construction of a harmonious society;and some inadequacies still need to perfect.
