知识产权角度审视下的我国外资控制研究

从改革开放的第一天起,引进外资就成为了我国实行跨越式经济发展战略的主要策略,而经济建设的成功也为这条策略打下了＂不败＂的烙印,甚至它也被移作为我国产业升级的圣经,用＂市场换技术＂的构想一度成为了我国科技兴国战略的指导方针。但是,近30年的实践证明,不仅＂市场换技术＂的预期未能实现,反而面临＂井喷＂式外资并购浪潮,民族企业的生存空间被压缩,经济安全面临外国战略性产业的蚕食和侵吞后可能造成严重的后果。因此,从知识产权法的角度对我国外资控制进行研究很有必要。

On the Control of Foreign Capital from the Perspective of Intellectual Property in China

Ever since the policy of reform and opening to the outside world,foreign investment has become a leap of implementing the major strategies of economic development.However,the practice in the past 30 years proved that not only ＂Market for technology ＂failed to achieve the expected,but faced with a ＂ blowout ＂type of foreign M A wave,the living space of national enterprises is compressed,and economic security of strategic industries exposed to foreign encroachment and the misappropriation of the possible serious consequences.Therefore,it is necessary for us to study the control of foreign capital from the knowledge the perspective of property law.
