| 摘 要： | 我国《婚姻法修正案》(以下简称《婚姻法》)确立的离婚过错损害赔偿制度,用法律的手段对婚姻当事人的合法权益进行更进一步的保护,是我国婚姻家庭立法的进步和完善。准确地把握离婚过错损害赔偿制度的构成要件有助于我们加深对该制度的理解。不过,作为一种权利救济制度,该制度还有待进一步完善。

| Abstract: | The divorce fault compensation system which was established in Amendment to Marriage Law(which is called Marrage Law for short) in China serves as further protection of the legal rights of the party in the marriage by means of the law,and is viewed as a progress and improvement of marriage family lawmaking of our country.Grasping the components of the divorce fault compensation system contributes to our comprehension of the system.However,as a kind of right relief system,the system still needs further perfection. |
