知识产权客体基本属性刍议

客体是一种权利的逻辑起点。一种权利的客体对于一种权利成为其自身而与其他权利相区别至关重要。在我国,知识产权的客体一般认为是无体物,从而认为无形性是其基本属性。其实,知识产权的客体与对象是一致的,知识产权的客体是与物质产品(即民法意义上的有体物或物权的客体)相并存的一种民事权利客体,非物质性是其基本属性。民法典严谨科学的体系必须建立在对物权、债权、知识产权等一系列民事权利的相对准确界定和清晰区分基础之上。

On the Basic Attributes of Intellectual Property Right Object

The object is a logical starting point of rights.It is crucial that the object of a right become a right of its own and be distinguished from other rights.In our country,the intellectual property rights' object is not generally considered to be three-dimensioned,and therefore,is regarded as invisible in terms of its basic attribute.Actually,the intellectual property rights' object and the target is consistent and the intellectual property rights' object and the physical product(namely,an object which has a shape and a real right in the sense of civil law)coexist and both are objects of civil rights.The non-materiality is its basic attribute.The rigorous scientific system of the civil code must be based on relatively accurate definitions and clear-cut differentiation of such terms on civil rights as real right,creditor's right,intellectual property right and so on.
