| 摘 要： | 现实社会的利益可以被独立地分为个人利益、社会利益和国家利益，其关系是特殊和一般的辩证关系；作为法的分类方法中的一种，部门法的划分在方法论上应该采取上行分类法，而不是现行的下行分类法（即坚持划分标准的单一模式）；在上行分类法中，社会法是作为一个独立的部门法存在的。
