论农业用地管理的制度安排与政策选择

目前,农业用地管理的矛盾和问题日益突显,这从根本上讲是由于农地产权存在主体虚置化、权利架空化、程序模糊化等立法上的问题。因此,必须对农地产权进行法律确认;必须弱化乡、村两级土地权限;必须积极推进农地市场化流转改革。同时,试点农地产权私有化改革,建立科学的征地补偿机制,等等,真正实现农地资源优化配置,从根本上解决农地管理问题。

At present,land-use for agricultural purposes has problems and contradictions that are becoming more prominent.Basically,this is because the subject tends to be void in terms of the land-use property right,the procedures becomes blurred,and so on.Therefore,the power at the township level and below must be limited in terms of land-use management;marketization of land-use for agricultural purposes must be advanced;privatization of land-use for agricultural purposes must be tried on a pilot basis,a reasonable compensation mechanism for land requisition must be set up,and so on,so that land-use for agricultural purposes can really be optimalized to fundamentally solve agricultural land-use management problems.
