| 摘 要： | 从社会主义计划经济向市场经济过渡过程中,一部分意志薄弱的干部利用手中的职权索贿、受贿的犯罪愈演愈烈.界定受贿罪与非罪需要正确分析犯罪主体与客体、确定犯罪行为的主观方面与客观方面并对受贿罪进行合理分类.这对司法机关有效地打击受贿犯罪具有重大的意义.

| Abstract: | During the process of the transformation from socialism planned economy to market economy, a part of officials make use of the the authority in hand to seek and accept bribe. The criminals grow in intensity. To define the criminal of bribery needs to correctly analyze the main body and object of bribery, make sure of the subjective aspects and the objective aspects in criminal behaviors and classify the bribery in reason, which can effectively help judicature organs to take strong measures against the bribery. |
