中国北极安全法律保障研究

北极气候与环境正在经历快速变化的过程，北极的地缘政治和法律问题也随着气候环境变化的影响与响应变得十分敏感。争取并维护我国在北极地区的权益，科学、合理开发利用北极地区的资源，促进我国经济社会可持续发展，将越来越受到人们的重视与关注。为此，我们必须对我国北极安全法律保障问题进行评估，构造“中俄北极合作组织”的法律框架。本文认为，在中国北极安全法律保障问题上要充分行使在北极事务活动中的参与权，保持我国在北极航道上的航行存在，从北极气候变化直接造成我国气候灾害的情况入手，努力将军事问题和经济问题分开考虑和解决，围绕着北极争议的共同点来寻找我国北极安全法律保障的切入点。

Researches on China' s Legal Protection of Its Arctic Security

The global climate and environment are also becomes much sensitive currently experiencing a rapid changing process, and with the impacts and responses of global climate changes, the Arctic geopolitics and legal issues will get more and more attention and concern to develop and utilize the resources benefits in the Arctic re- gion scientifically and reasonably, and to promote sustainable development in China＇ s economics, so as to pre- serve China＇ s interests in the Arctic region. Therefore, one should evaluate China＇ s Arctic secure legal protec- tion and build up the legal framework of ＂China and Russia Cooperation Organization＂. This paper is to con- clude that China chould fully perform the rights in the Arctic activity affairs, that it is necessary to maintain the presence of navigation in China＇ s Arctic waterways in Arctic security legal protection issues, and that from the perspective of Arctic climate change resulting in China＇ s climate-related disasters, military and economic issues should be considered and dealt with separately. It is helpful for China to be involved in the legal protection of the Arctic security by looking for the Arctic dispute issues in common.
