| 摘 要： | 预告登记后的权利是一种"债权物权化"的典型.预告登记具有预防妨害的效力、保全顺位的效力、保全权利的效力.但预告登记不能对抗不动产征收.预告登记权利人应当属于该不动产上的利害关系人,应当获得征收补偿.在违法不动产征收中,对于不动产尚未灭失的情况,可以采取物权请求权的保护方法,请求恢复原状;对于不动产本身已经灭失的情况,预告登记权利人可以采取侵权请求权的保护方法,请求损害赔偿.
