| 摘 要： | "人与自然和谐发展"追求公平、正义、平等等法治的基本价值.它不仅关心人的发展的代内公平与代际公平问题,以及人们环境权利与义务的正义性问题,还主张人的发展的规范性,从而实现环境发展的公平性.它把人与自然看作相互依存的平等关系,体现出人类对自我发展的尊重与对自然价值尊重的统一;它拓展了权利、义务的内涵和外延,要求实现人的发展与自然的发展在权利义务方面的统一.我们应该确立符合"人与自然和谐发展"的立法精神和原则,制定并实施符合"人与自然和谐发展"的法律法规,从而使人与自然和谐发展所追求的法治价值得以实现.
