| 摘 要： | 单一正犯体制是与区分制相对应的一种共犯制度模式,其外在特征是直接将参与犯样态包容于刑法分则的类型化行为当中,以获得与犯罪的直接实行者相同的定罪依据;其制度内涵是将参与犯样态与实行犯等价看待;其产生于区分制制度模式下区分实行犯与参与犯的现实困境。
