著作权合理使用制度

著作权合理使用制度是各国著作权法中通行的著作权限制制度,它允许作品的传播者与使用者不经过著作权人许可、不向著作权人支付报酬而利用受著作权保护的作品。只有在理论上论证著作权合理使用制度的合理性,在立法中保证其科学性,才能使著作权法律制度发挥其应有作用,实现其立法目的。本文从基本概念入手,分析了我国著作权合理使用制度的缺陷以及如何完善。

The Analysis of Conservative Use of Copyright

As a system to limit copyright widely accepted in copyright laws of different countries,fair use rule permits disseminators and users of works to exploit copyrighted works without the content of the copyright owner and to whom without payment.It is so important that only demonstrate its rationality both in theory and in legislating could make the legal system of the copyright realize its legislative purpose.This thesis analyze from the basic concept to discuss the limitation of the system of limit copyright and put forward the advice to consummate it.
