论欺骗性商业宣传行为与商业诋毁行为的竞合——《中华人民共和国反不正当竞争法》第5条第4项、第9条规定与第14条规范竞合的研究

从欺骗性商业宣传行为与商业诋毁行为的区别和联系入手,结合《中华人民共和国反不正当竞争法》等现行法律规定,论证了两种行为之间存在规范竞合。在经营者采取捏造、散布虚伪事实损害竞争对手商业信誉、商品声誉的方式来宣传或突出自己的商品或服务,导致消费者误认误购的情况下,同时构成欺骗性商业宣传行为和商业诋毁行为。其中商业诋毁行为应当是欺骗性商业宣传行为的特别行为,属于部分竞合的范畴,应当适用普通法与特别法的相关理论。

Study of the Concurrence between Fraudulent Commercial Propaganda and Commercial Defamation Acts: Article 5, Item 4;Article 9 and Article 14, the Law of PRC on Countering Unfair Competition

The paper firstly discusses the differences and connections between fraudulent commercial propaganda acts and commercial defamation acts,combining with the Law of the People's Republic of China on Countering Unfair Competition and other legislations to prove the concurrence between the norms.When the operators propagate or emphasize its goods or services with fabricated facts to do harm to the reputation of the competitors,what they have done leads to the fraudulent commercial propaganda acts and commercial defamation acts,among which,the commercial defamation acts should be regarded as the special acts of fraudulent commercial propaganda acts belonging to partial concurrence which is appropriated to the theories of general law and special law.
