本文从犯罪构成和罪刑均衡两个方面,分析了“携带凶器抢夺”行为的性质,对法律规定将其作为抢劫罪定罪量刑的适当性提出质疑。认为单纯携带凶器抢夺的行为,在性质上不同于抢劫,不符合抢劫罪的犯罪构成。将此行为依照抢劫罪的刑罚量刑,明显不适当,建议取消该规定。

Qqalitative Analysis on "Snatching with lethal Weapon"

This article analyses the quality of "snatching with lethal weapon" in 2 aspects: the constitution of a crime and the balance between crime and penalty.Then it raises doubts on the properness of declaring it robbery and imposing penalty.Snatching merely with lethal weapon is different from robbery in quality,so it doesn't constitute a robbery.It is obviously improper to declare it robbery and imposing penalty.As a result it should be canceled.
