| 摘 要： | 社会危害性是不是犯罪的本质特征,有没有必要继续在犯罪概念中继续存在下去,受到许多学者的质疑.本文从哲学的角度分析了社会危害性仍是犯罪的本质特征,认为从犯罪概念的历史发展和其功能上考察,社会危害性必须在犯罪概念中加以规定.

| Abstract: | s:Many scholars have doubts about whether social harmfulness is the essential characteristic of crime, whether it is necessary to go on existing in the concept of criminal.From the angle of philosophy,this article analyses that social harmfulness is still the essential characteristic of crime.Investigating from its historical development and functions,social harmfulness must be stipulated in the concept of criminal. |
