城市交通发展与市民文化权利保护——南京“法桐让路”事件的思考

我国城市交通发展过于强调"经济指标",使城市失去了"灵魂"与"记忆","文化贫困"成为一种普遍现象。要实现可持续交通发展,必须在发展中贯穿"权利保护"精神,城市交通发展以文化权利保护为目的,以文化权利谱系的拓展和保护作为度量基准。从权利本体视角看,文化权利是市民文化生活的"需求",城市交通发展是一种"供给"形式,而实现这种"需求"与"供给"的平衡,仰赖于市民有效参与城市交通发展决策。从"公民权利—政府义务"关系理论看,政府在城市交通发展中履行对文化权利的尊重义务、保护义务与给付义务,是市民文化权利的根本保障。

The development of urban public transport and the cultural rights of urban citizens: the urban street trees in Nanjing made way for urban public transport

The overemphasis of economic indicators in the development of urban transport in China today has deprived cities of their souls and memories,thus resulting in a common phenomenon of "cultural destitution".Sustained development cannot be achieved without an integration of development into the protection of rights.The development of urban transport should set cultural rights protection as its goal and the expansion of cultural rights as its standards.From the perspective of the subjects,cultural right is a demand of the urban citizens and the development of urban transport system is a form of supply;the supply-demand balance depends on urban citizens’ participation in the policy-making of the system.Government’s performance of the duty of respecting and protecting the cultural rights is a guarantee of urban citizens’ cultural rights.
