论普遍人权的主体开放性

普遍人权的普遍性在主体上表现为它的属人性 ,即平等地为每个人所享有。古典人权的主体封闭性使人权的普遍性原则在实践中不能得到贯彻 ,人权的普遍性原则出现理论与实践的脱节。普遍人权的主体开放性不是通过一个普适的标准来展现人权的普遍性 ,而是通过人权享有主体本身的广泛性来为这种普遍性原则的贯彻提供现实的感性基础。集体人权的主体可能性是普遍人权主体开放性的逻辑延伸和实际展开。
