| 摘 要： | 狭义的刑事政策导致刑事政策的窒息，缺乏生命力；人权保障要求凡是运用刑罚以及相类似的措施惩处的行为都应当纳入刑事政策的范畴，广义的刑事政策研究是必然趋势。刑事政策作为社会政策之一，其必须对其他具体社会政策（如人口政策）的内容予以体现，这一方面的研究为刑事法学界所忽视。

| Abstract: | The criminal policy in narrow sense results in asphyxia of criminal policy and lacks of vitality.The guarantee of human rights requires that criminal policy involve in action punished by penalty and other similar measures.The research on criminal policy in broad sense is inevitable trend.As a part of social policy criminal policy should embody the contents of the other social policy,such as population policy;this is often ignored by scholars of science of crimnal law. |
