| Abstract: | In the solution to the conflict problem of the right of name and the ownership of trademark, our legal regulation is relatively rough, and still at the primary stage of exploration. Through the analysis on the experiences of foreign law in the application, enrollment of trademark, as well as after its enrollment, the solutions to the conflict of the right of name and the ownership of trademark are explored mainly from three aspects of principle, substance and sequence. |
