| 摘 要： | 随着《刑法修正案（八）》的实施，理论界与司法实务界都逐渐认识到危险驾驶罪立法设置的必要性和适用的复杂性。对于犯罪的认定，需要从犯罪既遂形态类型、犯罪责任的要素、犯罪停止形态、罪数等角度进行深入分析，从而在宽严相济刑事政策精神的指导下准确认定本罪。

| Abstract: | With criminal law amendment Ⅷ＇s implementing,theorist and criminal justice authority are all realizing the necessity and complexity of crime of dangerous driving. To convict the crime ,the type of situation of the accomplishment of crime ,element of responsibility, suspended situation, quantity of crime were analyzed. The crime is confirmed in the spirit of the criminal policy of tempering justice with mercy. |
