论继承中债权人利益的保护

继承法颁布以来,中国的经济状况发生了巨大变化,个体经济和私营经济有了长足发展。随之而来的是新的继承纠纷层出不穷,债权人利益受侵害的问题显现得尤为突出,而中国现行继承法对债权人利益保护的规定却存在着明显的疏漏与不足。对遗产继承实践中债权人利益受侵害主要表现形式及对继承法债权人利益保护方面完善的方式进行了论述。

The state of economy in our country has changed a lot,since succession law was issued.Individual economy and private economy reach a new stage.Not only the personal property of some citizen has increased greatly in quantity,but also it has changed from simple means of subsistence to means of production.And the new inheritance dispute are emerging in quick succession.Especially the problem that creditor's claim came under attack is very serious.The regulations to protect creditor's claim in standing succession law exist oversights noticeably.This essay states the main forms to protect the creditor's interests and the measures to perfect the regulations in succession law for the creditor's interests.
