记者受贿与索贿的定性问题探讨

记者的采访或报道具有公务特点,应当归入＂国有事业单位中从事公务的人员＂,因而记者可以成为受贿罪主体。在司法实践中,有不少记者索贿案件是按敲诈勒索罪定罪判刑的。当属于＂国家工作人员＂的记者,在履行职责的过程中向被批评报道的单位索取财物,更符合受贿罪的构成要件;但是对冒充记者而索贿的,则可以界定为敲诈勒索罪。＂非国有事业单位＂与＂企业法人＂中的记者受贿、索贿,应构成＂非国家工作人员受贿罪＂。

Qualitative Discussior on Reporter Bribery and Extortion

The press coverage in official interviews or features,should be classified as ＂state-owned business units engaged in official business＂,so a reporter could be the main accepting bribes.In judicial practice,there are many cases bribes journalists convicted and sentenced by extortion.When a ＂national staff＂ in the press,in the performance of their duties in the unit to be critical reports obtained property,more elements of the crime of bribery;but posing as journalists and bribes,then can be defined as extortion and blackmail.＂Non-state institutions＂ and ＂corporate＂ in the press bribery,extortion,shall constitute the ＂non-national staff of accepting bribes.＂
