东北政务委员会合法性探究

东北政务委员会是张学良主政东北时期的最高行政机关,该机关虽在事实上行使着东北最高行政机关的职能,但其合法性却屡屡受到质疑和挑战。东北政务委员会的成立有其历史依据,但其存在却缺少法理依据,这正是国民政府屡屡谋划裁撤它的原因;然而奉系势力之强大及对稳定北方局势的重要意义,又迫使国府不得不作出妥协,最终承认了东北政务委员会存在的合法地位。从东北政务委员会的裁撤与反裁撤斗争中可以得出以下结论:一方面,奉系仍然有根深蒂固的旧军阀影子;另一方面,奉系国民党化进程缓慢。

On the Legality of the Northeast Administration Committee

The Northeast Administration Committee(NAC) before the Japanese occupied the Northeast China in 1930s was the supreme authority when Peter H.L.Chang was ruling over the region.Although NAC exercised its authority at that time,NAC itself was often regarded as illegal because of lack of juristic basis though it was the result of local history.This was just the reason why the Nanjing Central Government often tried to revoke it.On the other hand,because of the powerful strength of the Northeast Local Faction and its important influence on stabilizing the situation in North China,the Central Government had to compromise so as to admit the legitimacy of NAC.A conclusion is therefore drawn that the Faction was in the deep shadow cast by the old local warlords and very reluctant to accept KMT’s authority.
