小区车库(位)权属问题研究

摘    要:我国现行《物权法》对于小区车库(位)权属规则的设计存在不足,为了进一步解决司法实践中存在的小区车库(位)权属纠纷,在立法层面上应首先明确小区车库(位)的建筑物区分所有专有部分的属性;其次应确立以强制性建设为标准的划分方式,区分法定车库(位)与非法定车库(位);此外还应根据不同的小区车库(位)类别分别设立不同的权属规则.

A Research of the Ownership of Parking Places and Garage in Residential Quarters

Abstract:There are shortcomings in regulating the ownership of parking places and garage in The Real Right Law of the People's Republic of China. In order to resolve this kind of ownership disputes in residential quarters in the juridical practice, it is necessary to define the ownership of the exclusive parts of owners' partitioned building areas legally, divide the exclusive parking places from the common ones by means of mandatory construction and set up ownership regulations respectively according to various parking places and garage in residential quarters.
