| 摘 要： | 从横向来看,权利能力的起源与发展体现了人的解放过程,权利能力也使人与动物相区别。从纵向来看,二元存在、自我意识、表示意志和现世性是其存在理由。以"纯利益权利能力附停止条件说"和"利益关联说"解决未出生者的民法地位问题,以"近亲属利益关联说"解决死者的民法地位问题,使权利能力始于出生、终于死亡这一通说得以维持,有利于民法体系的稳定。

| Abstract: | Synchronically,the origin and development of right capacity embody the course of man's emancipation,thus distinguishing man from the animal.Diachronically,binary existence,self-consciousness,will expression and worldliness are the very reasons for its existence..To solve the civil law status problems of the individual un-born with the theory of "pure interests right capacity with stop terms" and the theory of "the benefit relation",and the civil law status problems of the dead with the theory of "close relative interests relation",maintaining the common explanation of right capacity are beneficial to the stability of the civil law system. |
