论居住权制度在我国的建立

我国并没有形成对居住权利规范且完整的保护制度。从物权法的发展趋势,我国的社会现实,司法实践之需求以及物权类型内部的协调、功能互补等方面考察,皆有建立居住权制度之必要。虽然2 0 0 2年提交的《民法典(草案)》首次在物权法编规定了居住权,但极不完备,尚有许多需要检讨和进一步完善之处。设计出一个适应我国国情的居住权制度,并协调居住权与其他民事权利可能发生的冲突是制定我国未来《民法典》的迫切任务。

On the Establishment of the Dwelling Right in China

The integrated and normative protection on dwelling right has not been established in China. The establishment of the dwelling right is indispensable from the points of view of the trend of the laws for property protection, the social needs, the requirement ofjudicatory practice and the mutual supplement and inner harmonization among the laws of property protection. Though dwelling right had been referred in the Civil Law (Draft) submitted in 2002, it is not perfect and needs to be improved further. It is an urgent job to design a system of dwelling right that is suited to the situation of China and can prevent the conflict between dwelling rights and the civil rights in future civil codes.
