论从抽象人格到具体人格及其法律规制

近代民法根基于商品经济,秉承斯多葛哲学以来的理性传统,历经近代人文主义思潮和启蒙思想的启迪,确立了抽象平等的法律人格。但进入20世纪以后,垄断加剧、社会动荡、各种不平等加剧,保护弱势群体成为一大法律问题,遂出现近代民法抽象人格向现代民法具体人格的转变思潮。然而,在作为"宪法"地位的民法典中不能用具体人格代替抽象人格,抽象人格仍具有不可动摇的地位。随着保护弱者地位的法律的增多,社会法逐渐形成,由此形成了具体人格根基的土壤。这一方面显示了民法发展的现代化,另一方面也显示了法律从二元法律结构向三元法律结构发展的精细化过程。在这一发展变化过程中,人更加受到关怀,人的尊严更加受到尊重。

From Abstract personality to Concreat Personality and Law System

Modern times civil law based on commodity economy carries on rational traditional philosophy since Sitog goes through the enlightment of the modern humanism and initiation,and sets up the abstract equal law personality. However,monopolization,social unsteadiness,and all kinds of unequabilities come from bad to worse since the 20~(th) Century,hence weak people's protection is raised,that's why modern times civil law's abstract personality turns into temporary concrete one It is admitted that abstract personality is unchangeable since it is unwise to proceed the change under the consideration of the status of civil law. With the commencement of increasing number of the weak people's law,social law is coming into being ,thus forms the soil for the root of concern personality.On one hand it is the demonstration of the modernization of civil law development,on the other hand it indicates the refined procedure of the change from duality to three-dimension. Human dignity enjoys more respect during the change.
