| 摘 要： | 发展信托经济，规范信托业的健康发展，信托立法意义重大。我国信托立法的出发点应为：一是借鉴信托法理，以信托本质去建构信托制度，二是净化现行扭曲了的信托制度，通过法律调控保证信托发挥其应有功能。我们要从信托立法的模式，信托业的调控思路以及信托法理借鉴等几方面来探讨这些问题。

| Abstract: | Turn legislation is of great imporance in developing turst industry and ist economy. The starting point of our turslegation should be firstly to establish trust system by the fiduciary legal principle, and secondly to purify the distorted trust system to bring into play its consequent fuction through leagal adjustment. A comprehensive analysis of these pointsis made here according to the pattem of trust legislation, the procedure of turst industry adjustemtne and the legal principleof trust. |
