| 摘 要： | 以发达的大学法律教育作为培养职业法官的基础性环节，这是当今世界主要法治国家的通例。但就大学法律教育在职业法官培养机制中的定位而言，却存在着英美法系专门职业教育与大陆法系普通学识教育的差别。与此两种模式相比，我国大学法律教育的定位不明，体制自身有待改善；并且缺失了技能培训这一职业法官培养的重要环节。基于此种认识，结合我国具体国情，本文提出了借鉴大陆法系做法，改革现行法律教育体制，建构我国司法研修制度的系统建议。

| Abstract: | It is a common practice in most countries ruled by law to carry out legal education in the university as a first step for proforsional judges training, but in terms of the role played by legal education in the university in training professional judges there exists a difference between Anglo-American Legal System and the Continental Legal System,with the former more deep-going in specified knowledge and the latter mere general. Compared to Ihese two systems, the role of legal education in the university in China is not clearly defined, system of organization needs improve ment, and skill taining as an important part is missing. In view of the above situation, this suggests that we adopt the continental legal system, change the current legal education organization, and construct our own judicial research and study system. |
