| 摘 要： | “保障措施”条款是世贸组织的例外条款之一,是国际法的“情势变迁原则”在国际贸易关系中的具体运用。我国在保障措施的实施方面还面临一些问题,如不熟悉保障措施的有关知识,保障措施立法不完善,实施保障措施时面临困境,应对保障措施制裁时处境不利,等等。为此,应普及保障措施的相关知识,完善我国保障措施立法,有效运用保障措施保护国内产业,合理应对国外保障措施制裁。

| Abstract: | There are some problems that our country will face, such as unfamiliarity with knowledge about safeguard measures, problem in implementing safeguard measures, problem in coping with safeguard measures,and so on. To solve the problems, we should popularize the relevant knowledge, implement safeguard measures effectively and strike back the abuse of safeguard measures implemented by other WTO members. |
