论现代乡村人民调解制度的建构

随着乡村社会的逐步转型，以调解为主的传统纠纷解决机制呈现日趋弱化迹象，严重影响新农村的建设与和谐社会的构建。在这种新形势下，有效整合本土资源，构建现代乡村人民调解制度就显得十分迫切。这不仅是对中国传统法律文化历史延续性的尊重，更是顺应乡村社会变迁，在制度上对传统解纷机制的一次超越。

Transmission and Transcendence:The Construction of Modern Mediation System of the People in Rural Community

Mediation has been a good tradition in China since ancient times.With the gradual transformation of the rural community,the traditional mechanism of dispute settlement is declining,in which mediation plays a dominant role.It is severely affecting the construction of new countryside and harmonic society.Against such a background,it has become imminent to effectively tap the local resources and construct a modern mediation system of the people in rural community which not only respects historical continuity of Chinese traditional law culture,but also accommodates the transition of the rural community,carrying out the transcendence of the traditional dispute settlement mechanism.
