| 摘 要： | 社会稳定风险评估在重大决策程序中的引入,旨在通过一种自主性、嵌入性的程序构造,拓展传统的决策程序结构,增强决策过程的风险意识。社会稳定风险作为一种次生性、社会性、综合性风险,具有不同于技术性风险的特质,这要求社会稳定风险评估的制度建构,应当以决策过程开放、决策理性和决策民主为导向。社会稳定风险评估作为一种裁量程序,在实践中面临诸多难题,亟需将其纳入法治轨道。

| Abstract: | The introduction of risk assessment of social stability into major policy-making process is aimed to change the structure of policy-making and improve risk awareness of policy-making through an independent and embedded procedure building.The risk of social stability is a subsequent,social and comprehensive risk,which is very different from the technical risk.This requires openness,rationality and democracy of policy-making during risk assessment institution building.It is crucial to bring risk assessment of social stability into the channel of rule of law. |
