| 摘 要： | 伴随着环境保护的全球化进程,作为美国国内法的ATCA突破了传统适用范围的限制而被运用于跨国界的居民环境权保护,允许对政府支持的环境退化行为提起诉讼,为实现世界范围的环境保护提供了一条新的路径.但是,环境保护全球化背景下ATCA的扩大适用,在为解决世界环境保护问题发挥着积极作用的同时,也存在着明显的局限性.应对全球环境危机,有待于协调各国环境标准以建立国际统一的环境准则和环境保护法规.
