| 摘 要： | 侵犯商业秘密罪是我国刑法知识产权犯罪中的一个罪名,该罪的客体是权利人的财产权及公平竞争的市场秩序;该罪的罪过形式只能是故意,过失不能构成该罪;在认定侵犯商业秘密罪时,应当注意罪与非罪以及该罪与盗窃罪、有关侵犯国家秘密的犯罪的界限.

| Abstract: | Crime of invading business secrets is one accusation of intellectual property right. The object of this crime is the obligee's property right and the market order based on the fair competition; it is only committed on deliberate intention; when the crime of invading business secrets is determined, it is necessary to distinguish between crime and non-crime, and among this crime, banditry and the crimes of invading national secrets. |
