论地方立法中利益集团利益妥协机制的建立

立法是资源配置和利益分配的一种方式,也是利益协调的过程。地方立法是我国立法体系的重要组成部分,与公民的切身利益息息相关。随着人们民主法制意识的增强和地方立法公众参与的扩大,越来越多的利益集团通过参与立法为本集团成员争取和维护利益。目前我国的利益集团还处于初步发展阶段,在参与地方立法中存在组织方式不成熟、集团力量不平衡和参与方式不规范等问题。为了平衡利益集团的利益,提高地方立法的科学性、民主性和可行性,地方立法机关应该采取遏制与平衡的策略,加强观念培育和制度建设,在地方立法中为利益集团建立有效的利益妥协机制。

On the Establishrment of Interest Groups' Compromising Mechanism in Local Legislation

Legislation,as a way of the allocation of resources and benefits,actually,is a process of coordinating the interests.Local legislation is an important part of China’s legislative system,and it is closely related to the vital interests of citizens.With the expansion of the public participation of the people’s awareness of democracy and the rule of law and local legislation,a growing number of interest groups involved in local legislation strive for benefits.However,the interests groups are still in the early stage of development in our country.Such organization is immature.Group power is unbalanced and the participation is not standardized.To balance the interests of interest groups and improve the scientific,democratic and feasibility of local legislation should take the strategy of containment and balance.We should update concept and strengthen the system construction,establishing an effective interests of compromising mechanism for the interest groups.
