| 摘 要： | 《民法总则》绿色原则的提出,为我国科技创新法律生态化研究提供了理论支撑。科技创新法律生态化以可持续发展观为价值导向,兼顾科技创新持续发展和保护生态环境。通过对科技创新法律生态化基础理论的阐述,分析我国当前科技创新法律生态化的立法现状及发展趋势,借鉴国外相关法律规制,探讨我国科技创新法律生态化存在的不足以及完善措施。

| Abstract: | The introduction of green principle of the General Principles of Civil Law provides theoretical support for the ecological research for scientific and technological innovation laws. The ecology of scientific and technological innovation laws takes the concept of sustainable development as value orientation, and at the same time takes the sustainable development of scientific and technological innovation and the protection of ecological environment into account. Through the elaboration of basic theories of ecology of scientific and technological innovation laws, the current situation and development trend of legislation are discussed of ecology of the scientific and technological innovation law in China. The relevant foreign laws and regulations are expounded. And the shortcomings and perfecting measures are explored concerning the ecology of scientific and technological innovation laws in China. |
